Are You Safe From A European Arrest Warrant?

You might think you’re fairly safe, you’ve never committed any heinous crime or have any intention of doing so. You might not strictly be right though.

Introduced in 2003 the Extradition Act came about after a decision made on the back of the September eleventh attacks which was sold as a means of being able to send international terror suspects to the country in the Union that they were threatening. The theory was that any arrest warrant issued in Europe, under the European convention on human rights should be enforceable anywhere.

But judiciaries don’t operate like that, do they? Approximately three people are extradited every day from the UK, and few of them are terror suspects, in fact most of them haven’t committed an offence that would necessarily be prosecuted in Britain because many of the cases would be regarded as too petty or trivial.

There was recently a case being fought by a 58 year old science teacher who cares for a disabled spouse fighting extradition from the UK on a ten year old charge of exceeding his overdraft limit. No one even suspects him of any kind of dishonesty but going over your approved limit is a criminal offence in Poland and in Poland every criminal offence has to be investigated by the police and prosecuted, no matter how trivial.

The bank has already been repaid but the nature of the law in Poland means that their judiciary have made 5,000 requests for extradition in 2010, 40% of all those made to Britain. Britain made220.
